Amendments to the regulations

In December 2005 the Government announced changes to the targets and regulations, which came into effect for England, Scotland and Wales in January 2006. Please note these changes do not apply at present to companies in Northern Ireland.

The changes are summarised below and full details are available by clicking on the first word.

Targets: The Government has amended the overall recovery and material specific recovery and recycling targets for the coming 5 years. The target for 2006 is a 3 point increase on 2005.

Small and Medium Enterprises (SMEs): The government have announced the introduction of a new method of compliance for smaller companies, intended to make data submission easier.

Pub operating businesses: In future, Pub companies operating tenanted pubs will incur any collective obligation arising from pubs that do not individually meet the thresholds. Individual pubs exceeding the thresholds remain obligated.

Franchises: In future, Franchisors incur the obligation for franchisees who individually do not meet the thresholds, but collectively do. Franchisees meeting the thresholds retain their independent obligation.

Leased packaging: Companies leasing packaging, subject to meeting the thresholds, will in future incur the packing/filling and selling activity obligations on the first use of leased packaging. There is no change to the status of companies leasing packaging, who do not incur any obligation under this legislation.

Second hand imported packaging: Under the amended regulations, second hand imported packaging is now obligated.
